Justice and Media

It appears that justice is what media will say and not the Courts. Since last day when the C.J.M. Bhopal had pronounced judgment in the case of Gas disaster the media for no reason instigating the viewers and the victims of gas disaster that the sentence passed by the trial court does not justify the crime committed by the accused persons.
The case of the prosecution was very simple that due to leakage of gas the disaster happened. There is vast difference between murder (Sec.302 IPC), culpable homicide not amounting to murder (Sec.304 IPC) and causing death by negligence (304A IPC). The Supreme Court had well interpreted these sections and had said that this case was of rash or negligent act of the Carbide Gas and cannot be said that there was an intention on the part of the said company to commit culpable homicide (human death).
The maximum sentence provided in Sec.304A is only 2years and fine unlimited. The accused persons are sentenced to 2years rigors imprisonment and fine of Rs.5 lacs each keeping in view the provision of Sec.71 of the IPC. The sentence by the court trying the case is most reasonable, rational and legal also. This was a routing judgment passed by the court in the case but the TV media has always to blow out of proportion to chew the time and for that repeated news with maximum instigation is being presented. This is all misuse of freedom of speech enunciated in the Constitution. Not fair on the part of the media. Why the media was silent when the case was being presented to the Supreme Court and why it did not help the victims to represent the case in effective way. After hearing the case the court has held what was just and reasonable. The courts do not do that Netagiri which the media and in particular the TV media does. The courts decide cases according to law keeping humanitarian view in mind but in any case cannot cross its legal limits.
People should remember that it was then Arjunsingh the then Chief Minister of the M.P. who set up judicial commission but of his own accourt winded up the same. Why it was done so? That time people ought to have smelled some thing otherwise but since it was political decision it could be digested by the media for best known reason to public. Media is never fair and cannot see the facts as they are but it always see them with bias- ness and oblique motive. In all the judgment is quite fair. How ever people affected by the disaster may approach the High Court through the Government to file appeal for enhancement of fine but nothing more can be done. People might be thing that they should get compensation for damage caused to them in perpetuity.
In fact due to political corruption, yes due to political corruption Warren Anderson could not be arrested and for that the Arjunsingh Government was totally responsible but the Media kept silence in this respect and did not persuade the victims to compail the government for his arrest. A bad practice by media to interfere in the judicial process to undermined it. A pure non-sense play is being played by the media and the governments always tolerate it as it has under hand relations with it as both play hide and sick game with the public and black money may be the pivot behind it. Nothing wonderful.
